In an accident-insurance appeal already partially allowed, the president of the Ticino cantonal insurance court examined the lawyer's fee note submitted for taxation. Relying on Art. 21 of the cantonal Procedural Act, he fixed the taxable fee at CHF 2,000, VAT included. He further ordered that no court fee be collected and that the expenses be borne by the State. He also stated that the lawyer and the Department of Institutions could challenge the amount before the Council of Moderation within 15 days.
Art. 21 of the Ticino cantonal Procedural Act; taxation of counsel fees and allocation of procedural costs. Where the court taxes a lawyer’s note after proceedings in which legal aid has been granted, it may fix the compensable fee by reference to the submitted bill and determine the amount as taxed, VAT included. In such a taxation order, the court may waive the justice fee and place the expenses on the State. The taxation figure is separately open to review by the competent moderation body within the prescribed time limit.

rilevato che in data 16 maggio 2002 l'avvocato __________ ha trasmesso l'allegata nota d'onorario per la tassazione;
visto in particolare l'art. 21 della Legge di procedura 6.4.61;
ordina 1. La nota è tassata in fr. 2'000.- (IVA inclusa);
Non si percepisce tassa di giustizia, mentre le spese sono poste a carico dello Stato.
Contro l'ammontare dell'onorario il patrocinatore e il Dipartimento delle Istituzioni possono ricorrere entro 15 giorni al Consiglio di moderazione.
