la decisione su opposizione del 27 agosto 2004 emanata da
in materia di assicurazione federale per l'invalidità
letti ed esaminati gli atti;
richiamata l'ordinanza 23 settembre 2004 con la quale il Tribunale ha assegnato alla parte convenuta il termine di rito per presentare la risposta;
vista la lettera 12 ottobre 2004 del rappresentante dell'assicurato del seguente tenore:
" In data 21 settembre 2004 è stato introdotto ricorso cautelativo, con contemporanea richiesta di sospensione della causa, in attesa della presa di posizione della Cassa di compensazione __________, riguardo la richiesta di assegnazione della mezza rendita di invalidità per caso di rigore.
In questi giorni ci è pervenuta la nuova decisione dell'Assicurazione federale per la vecchiaia, i superstiti e l'invalidità (AVS/AI) datata 6 ottobre 2004, con cui è stato riconosciuto al signor __________ quanto richiesto (doc. _).
Premesso quanto sopra, si ritira il ricorso 21 settembre 2004, in quanto ormai privo d'oggetto, con contestuale richiesta di stralcio della causa dai ruoli. (…)" (doc. IV)
rilevato che la causa è divenuta di conseguenza priva di oggetto;
viste le disposizioni della Legge di procedura 6.4.61;
decreta 1. la causa è stralciata dai ruoli;
non si percepiscono né tasse né spese;
intimazione alle parti a sensi ed effetti di legge.
