contro

la decisione n° 7151/403 dell’11 marzo 2005 emessa dalla Sezione della circolazione, Camorino,

viste le osservazioni presentate dalla Sezione della circolazione;

letti ed esaminati gli atti,

considerato in fatto ed in diritto

  1. La Sezione della circolazione con decisione dell’11 marzo 2005 ha inflitto a RI 1 una multa di fr. 100.-, oltre alla tassa di giustizia di fr. 20.- e alle spese di fr. 10.-, per aver circolato con il veicolo __________ impiegando, durante la guida, un telefono senza il dispositivo “mani libere”.

  2. Contro la predetta pronuncia dipartimentale RI 1 si aggrava ora davanti a questo giudice chiedendone l'annullamento.

Eccepisce in particolare che alla guida del veicolo all’orario della contravvenzione c’era sua moglie __________

  1. Di conseguenza alla luce delle dichiarazioni del ricorrente - peraltro comprovate da alcune dichiarazioni scritte di terze persone - il ricorso deve essere accolto, senza ulterioremente addentrarsi nel merito del gravame, riservata la facoltà della sezione della circolazione di riprendere ex novo la procedura nei confronti dell’autrice dell’infrazione.

dichiara e

pronuncia: 1. Il ricorso è accolto.

§ Di conseguenza è annullata la decisione n° 7151/403 dell’11 marzo 2005 emessa dalla Sezione della Circolazione.
