letti ed esaminati gli atti;
richiamato lo scritto 26 gennaio 2004 del Tribunale alla Fiduciaria __________ del seguente tenore:
" Con la presente la preghiamo di trasmetterci a stretto giro di posta la decisione su opposizione 23.12.2003 contro la quale ha inoltrato il ricorso sopra indicato.
La avvertiamo che senza tale documento il Tribunale non può iniziare il trattamento della causa. (…)" (cfr. Doc. _I)
vista la lettera del 30 gennaio 2004 della Fiduciaria __________ che comunica il ritiro del ricorso (cfr. Doc. _);
rilevato che la causa è divenuta priva di oggetto;
viste le disposizioni della Legge di procedura 6.4.61;
decreta 1. la causa è stralciata dai ruoli;
non si percepiscono né tasse né spese;
intimazione alle parti a sensi ed effetti di legge.
