la decisione 27 agosto 2004 emessa dalla Sezione della circolazione, Camorino,
letti ed esaminati gli atti;
ritenuto, in fatto ed in diritto
A. Il 22 settembre 2004 RI 1 ha inoltrato ricorso contro la decisione 27 agosto 2004 con cui la Sezione della circolazione gli ha inflitto una multa di
fr. 400.-, oltre la tassa di giustizia di fr. 80.- e le spese di fr. 30.-, per aver effettuato su una semiautostrada, alla guida del motoveicolo __________, una manovra di inversione di marcia transitando su una superficie vietata.
B. Si rileva che la menzionata decisione è stata notificata al ricorrente il 30 agosto 2004; ne consegue che il termine perentorio di 15 giorni per la presentazione del ricorso, ai sensi degli art. 4 cpv. 2 e 7 cpv. 5 LPContr, è scaduto il 14 settembre 2004.
Pertanto il ricorso 22 settembre 2004 è tardivo e deve essere dichiarato irricevibile, senza nemmeno dover procedere all'assegnazione all'insorgente di un termine perentorio per la traduzione in lingua italiana.
C. Visto l'esito del gravame non si può prescindere dall'applicazione di una modica tassa di giustizia (art. 15 LPContr).
Per questi motivi, visti gli artt. 4, 7, 15 LPContr;
dichiara e
pronuncia: 1. Il ricorso 22 settembre 2004 inoltrato da RI 1 è irricevibile.
La tassa di giustizia e le spese per complessivi fr. 50.- sono a carico del ricorrente.
