ritenuto, in fatto ed in diritto

A. Il 9 ottobre 2003 __________ __________ ha inoltrato ricorso contro la decisione 26 settembre 2003 con cui la Sezione della circolazione gli ha inflitto una multa di fr. 300.-, oltre fr. 60.- di tassa di giustizia e fr. 70.- di spese, per aver eseguito, alla guida della vettura __________, un cambiamento di corsia, da destra a sinistra, collidendo con un autoveicolo sopraggiungente da tergo.

Il ricorso era redatto in lingua tedesca.

B. In data 16 ottobre 2003 questa Autorità ha scritto al ricorrente quanto segue:

"in possesso del suo scritto citato a margine le comunico che, conformemente alle norme stabilite dagli articoli 4 e 5 della Legge di procedura per le contravvenzioni (LPContr):

art. 4 3 il ricorso deve contenere:

a) la menzione della decisione impugnata;

b) una concisa esposizione dei fatti con l'indicazione dei mezzi di prova richiesti;

c) una breve motivazione;

d) le conclusioni.

Al ricorso devono essere allegati la decisione impugnata e ogni altro documento.

art. 5 1 Il ricorso deve essere scritto in lingua italiana e firmato dalla parte o dal suo procuratore.

art. 5 2 Errori di scrittura o di calcolo possono essere rettificati in ogni momento.

In applicazione dell'art. 6 LPContr, con la presente le viene assegnato un termine perentorio di 10 giorni per ripresentare il ricorso in lingua italiana, nella forma indicata, con la comminatoria che, trascorso infruttuoso tale termine, il ricorso darà dichiarato irricevibile."

Si rileva che il menzionato scritto è stato notificato al ricorrente il 24 ottobre 2003; ne consegue che il termine perentorio di 10 giorni per la presentazione del ricorso in lingua italiana, ai sensi degli art. 4, 6 e 7 LPContr, è scaduto infruttuosamente il 3 novembre 2003.

Il ricorrente ha dato seguito alla richiesta il 4 novembre 2003, ossia tardivamente. Il ricorso è pertanto irricevibile.

Per questi motivi, visti gli artt. 4, 7, 15 LPContr;

dichiara e

pronuncia: 1. Il ricorso 9 ottobre 2003 inoltrato da __________ __________, __________, è irricevibile.
