The President of the Pretura penale of Bellinzona ruled on a request to convert an unpaid fine into arrest. rilevato che la multa non è stata pagata e che ogni tentativo di incasso è risultato infruttuoso;
citat il giorno ____________________ 2004, non è comparsa;
considerato pertanto che occorre procedere alla commutazione della multa inflitta, in ragione di un giorno di arresto ogni fr. 30.-- di multa, ma al massimo novanta giorni;
richiamati gli art. 49 cifra 3 CP e 347 CPP,
pronuncia 1. L'istanza del IS0 di commutazione della multa in arresto è accolta.
Di conseguenza la multa di fr. 1'200.-- inflitta a CD0 con decreto numero DAC / di data ____________________ 2002, è commutata in 40 giorni di arresto.
