la decisione 24 aprile 1998 del Giudice di pace del circolo di Carona nella causa promossa contro il qui ricorrente da

Richiamata la diffida 13 maggio 1998 del presidente di questa Camera mediante la quale al ricorrente veniva assegnato un termine scadente il 2 giugno 1998 per effettuare sul c.c.p. 69-10370-9 del Tribunale d’appello -introiti AGITI- un deposito di fr. 100.-- a titolo di anticipo per le presunte spese giudiziarie, con la comminatoria che, in caso di mancato versamento dell'importo entro il termine fissato, il ricorso sarebbe stato dichiarato deserto ai sensi dell'art. 312 CPC;

ritenuto che da verifiche effettuate da questa Camera presso il competente ufficio postale risulta che la richiesta di pagamento dell’anticipo -notificata mediante invio raccomandato n. __________- è stata regolarmente recapitata al destinatario il 15 maggio 1998, quindi prima della scadenza del termine di pagamento;

preso atto come il termine in questione sia infruttuosamente trascorso;

decreta: 1. Il ricorso 11 maggio 1998 di _____________, avverso la decisione 24 aprile 1998 del Giudice di del Circolo di Carona, di cui sopra, è stralciato dai ruoli per mancato versamento dell'anticipo.

  1. Le spese del presente giudizio con tassa di giustizia per complessivi fr. 80.-- sono poste a carico del ricorrente.

  2. Intimazione:

Comunicazione alla del Giudice di pace del circolo di Carona.
