Zusammenfassung

The Ticino Camera di esecuzione e fallimenti of the Court of Appeal dealt with a complaint against an enforcement office attachment record. After the complainant’s counsel informed the court that the parties had reached a settlement, the attachment no longer had any object. The court therefore held that the complaint had also become moot and ordered it struck off the docket. No costs or indemnities were charged.

Art. 67 cpv. 2 OTLEF; art. 68 cpv. 2 OTLEF: if, during supervisory complaint proceedings concerning an attachment measure, the underlying measure loses its object because the parties settle, the complaint likewise becomes devoid of purpose and is to be struck off the roll. In such a case, the court may dispense with costs and indemnities where the circumstances so justify (consid. 1-2).
