Zusammenfassung

The supervisory complaint concerned the enforcement office’s notification of the receipt of a sale request in two enforcement proceedings. The court had previously granted suspensive effect. Before the merits could be decided, the creditor’s counsel informed the court that the sale requests were withdrawn. The court therefore held that the complaint had become devoid of object and ordered it struck from the docket. It also decided that no costs would be levied and no indemnity would be awarded.

Art. 67 cpv. 2 and 68 cpv. 2 OTLEF; supervisory complaint becomes moot after withdrawal of the measure contested. Where the creditor withdraws the underlying sale request, the object of the complaint concerning the service of the receipt notice falls away and the proceeding is to be struck from the docket. In such a case, the supervisory authority may dispense with costs and compensation, according to the circumstances and the applicable enforcement rules.

richiamati gli art. 67 cpv. 2 e 68 cpv. 2 OTLEF
