Zusammenfassung

The supervisory complaint against two enforcement orders was filed in Lugano. Before the court ruled, the creditors withdrew the underlying enforcement proceedings. The Camera di esecuzione e fallimenti held that the complaint had therefore become moot and ordered it struck from the docket. No costs or indemnities were awarded.

Art. 67 cpv. 2 and 68 cpv. 2 OTLEF; a supervisory complaint in debt enforcement becomes moot when the challenged enforcement proceedings are withdrawn and no live object of dispute remains. In such a situation the authority strikes the matter from the roll ex officio, without adjudicating the merits; where the case has become devoid of object, no costs or indemnities are to be awarded absent special circumstances.
