visto l’appello 9 febbraio 2006 interposto da

RI 1

contro la chiusura del fallimento decretata il 4 gennaio 2006 dal Pretore della __________;

ritenuto in fatto e considerato in diritto:

che l’appellante si aggrava contro il decreto di chiusura del fallimento, affermando che i suoi crediti non sono stati iscritti nella graduatoria e non sono stati oggetto di una decisione di contestazione;

che con sentenza odierna (inc. 15.2006.24), questa Camera ha dichiarato tardivo il ricorso interposto dall’appellante contro la graduatoria;

che in queste condizioni, poiché la graduatoria è da considerare cresciuta in giudicato, l’appello va respinto;

che le spese seguono la soccombenza (art. 48, 49, 61 cpv. 1 e 62 cpv. 1 OTLEF);

che non si assegnano indennità, l’appello non essendo stato intimato all’amministrazione speciale in virtù dell’art. 313bis CPC (per il rinvio dell’art. 25 LALEF).

Per questi motivi,

richiamati gli art. 268 LEF, 18, 19, 25 LALEF e 313bis CPC

pronuncia:

  1. L’appello 9 febbraio 2006 della RI 1, __________, è respinto.

  2. La tassa di giustizia di fr. 100.-- è posta a carico dell’appellante. Non si assegnano indennità.

  3. Intimazione a:
