statuendo nella procedura di concessione di moratoria a scopo di concordato, pendente davanti alla Pretura di __________ nei confronti di

AO 1 rappr. da: RA 2

in cui - contro la decisione di concessione della moratoria presa il 24 ottobre 2005 - si appella con atto 26 ottobre 2005

AP 1RA 1 rappr. da:

chiedente, in riforma della decisione pretorile 24 ottobre 2005, che l'istanza di concessione della moratoria per scopo di concordato presentata il 23 settembre 2005 da AO 1, sia respinta;

preso atto che, in seguito al fallimento dell'appellante decretato il 9 dicembre 2005 e poi sospeso per mancanza di attivo il 10 gennaio 2006, AP 1 ha ceduto ogni sua pretesa nei confronti di AO 1 alla società __________, e ciò in data 3 febbraio 2006;

considerato che la menzionata società cessionaria, in data 2 marzo 2006, ha formulato domanda di poter subentrare nella causa a AP 1, in applicazione dell'art. 110 cpv. 2 CPC;

fissato da questa Camera a AO 1 un termine per comunicare se si opponesse o no alla domanda di __________

preso atto che il commissario del concordato di AO 1, RA 2, si è opposto al postulato subingresso;

considerato

in diritto:

che l'art. 110 CPC prevede -se l'oggetto litigioso è alienato- che l'acquirente possa subentrare all'alienante in una causa civile, purché sia dato il consenso delle parti;

che, in concreto, ritenuto oggetto litigioso il credito vantato da AP 1 nei confronti di AO 1, l'auspicato subingresso potrebbe avvenire solo con il consenso delle parti, ciò che non è dato;

che di conseguenza la domanda di subingresso dev'essere respinta;

che comunque, per quanto riguarda il merito dell'appello, è doveroso prendere atto dell'avvenuta cessione di ogni pretesa creditizia verso AO 1 da parte dell'appellante in favore di __________, atto che nessuno peraltro contesta;

che ciò rende tuttavia AP 1 priva di titolo per presentare l'appello in esame, fondato sulla sua (ormai decaduta) qualità di creditrice di AO 1;

che infatti, l'art. 294 LEF riconosce la facoltà di interporre appello contro la concessione di una moratoria concordataria al debitore, al creditore richiedente ed eventualmente, almeno ai creditori (Vollmar, in Comm. di Basilea, art. 294 LEF, N. 18 e 19; Cocchi/ Trezzini, CPC-TI, art. 22 LALEF, m. 7);

che d'altra parte non risulta che __________ abbia nuovamente ceduto a AP 1 i crediti vantati al momento di introdurre il presente appello che deve così essere respinto per carente legittimazione attiva dell'appellante.

Motivi per i quali,

richiamato per le spese l'art. 148 CPC,

pronuncia:

  1. L'appello 26 ottobre 2005 di AP 1 è respinto.

  2. Le spese e la tassa di giustizia per complessivi fr. 100.-, anticipati dall'appellante, restano a suo carico. AP 1 verserà inoltre a AO 1 l'importo di fr. 300.- a titolo di ripetibili.

  3. La domanda di subingresso di __________ è respinta.

  4. Intimazione: RA 1, Corso Elvezia 25, Lugano:
