The Ticino bankruptcy appellate chamber considered an appeal against a bankruptcy decree of the Pretore of Mendrisio nord. On the appellant’s request for suspensive effect, it granted only partial suspension. It also ordered the Mendrisio debt enforcement office to inventory the assets and to enter the restriction on disposal of the appellant’s immovable property.

Le juge d’appel peut n’accorder qu’un effet suspensif partiel et, dans le cadre des mesures conservatoires, ordonner l’inventaire des biens ainsi que l’annotation de la restriction du pouvoir de disposer sur les immeubles afin de préserver la masse en attendant la décision au fond.

il decreto di fallimento 11 agosto 2003 del Pretore della giurisdizione di Mendrisio nord nella procedura promossa da
vista la domanda di effetto sospensivo contenuta nell’appello
richiamati gli art. 174 e 170 LEF
decreta 1. Al ricorso è accordato effetto sospensivo parziale.
L’Ufficio esecuzioni e fallimenti di Mendrisio, allestirà l’inventario dei beni e provvederà all’annotazione della restrizione della facoltà di disporre dei beni immobili dell’appellante.
