in materia di contratto di locazione che il Pretore, con sentenza 12 giugno 2006, ha parzialmente accolto condannando i convenuti a pagare, per pigioni arretrate e per quelle sino alla fine della locazione, accertata a fine maggio 2006, l’importo di Fr. 10'924.45.

Ed ora sullo scritto 2 luglio 2006, spedito il successivo 5 luglio, alla Pretura con il quale i convenuti dichiarano il loro disaccordo con la decisione e che è stato trasmesso a questo Tribunale a valere quale atto d’appello.

Letti ed esaminati gli atti ed i documenti di causa

Considerato

in fatto ed in diritto

che, nelle procedure in materia di locazione, il termine per ricorrere contro una sentenza del Pretore è di 10 giorni (art. 411 cpv. 2 CPC);

che la sentenza del Pretore è stata spedita il 13 giugno 2006 ed il relativo plico raccomandato distribuito al domicilio dei signori AP 2 il 14 giugno 2006 (cfr www.posta.ch/trackandtrace con riferimento alla spedizione 98.00.650051.00188743);

che, di conseguenza, il termine per proporre l’appello scadeva il 26 giugno 2006 e l’impugnazione dei convenuti, impostata il 5 luglio 2006, è ampiamente tardiva e quindi irricevibile;

che, a dipendenza della tardività del ricorso, non torna conto esaminare se la lettera dei ricorrenti adempie ai requisiti minimi di forma e di argomentazione, per un ricorso, così come prescritti dall’art. 309 CPC, in particolare se contiene i motivi di fatto e di diritto sui quali si fonda;

  1. L’appello 2/5 luglio 2006 di AP 1e AP 2 è irricevibile perché tardivo.

  2. Non si prelevano tasse o spese.
