in materia di locazione (protrazione della locazione) che il Pretore, con sentenza 18 agosto 2005, ha respinto confermando la fine del rapporto di locazione tra le parti al 31 dicembre 2005.
Appellante la parte istante la quale, con appello 29 agosto 2005, ha chiesto la riforma del primo giudizio nel senso di vedersi concessa una protrazione della locazione sino al 31 dicembre 2007, mentre la controparte, con osservazioni 3 ottobre 2005 chiede la reiezione del gravame.
Ed ora sullo stralcio della procedura d’appello avendo la parte istante, con lettera 17 novembre 2005, dichiarato di ritirare l’appello.
Ritenuto che la desistenza dell’appellante comporta di addossarle tasse, spese e ripetibili della procedura d’appello.
pronuncia 1. La procedura d’appello di cui all’inc. 12.2005.143 di questa Camera è stralciata dai ruoli per desistenza.
La tassa di giudizio di Fr. 100.– e le spese di Fr. 50.– (totale Fr. 150.–) già anticipate dall’appellante rimangono a suo carico con l’obbligo di rifondere a controparte Fr. 400.– per ripetibili d’appello.
