sedente per statuire nella causa inc. n. OA.2002.88 della Pretura della giurisdizione di Mendrisio nord promossa con petizione 22 luglio 2002 da

AO1 (rappr. da RA2)

contro

AP1 (rappr. __________ RA1)

nella quale il Pretore, con decisione 10 marzo 2004, ha respinto l'eccezione di incompetenza territoriale sollevata dalla parte convenuta.

Ed ora sull'appello 19 aprile 2004 della convenuta la quale chiede la riforma del primo giudizio, nel senso di accogliere l'eccezione e di respingere la petizione.

Ritenuto che, con scritto 7 ottobre 2004, __________, così incaricato dalle parti, ha chiesto lo stralcio della procedura d'appello e di quella di prima istanza avendo le parti sottoscritto un accordo di transazione, nel frattempo completamente adempiuto.

Considerato che questa Camera può procedere allo stralcio della procedura d'appello, mentre lo stesso incombente per quello che è della causa avanti al Pretore compete a questo magistrato.

Atteso che le parti hanno pure convenuto che tasse e spese di giudizio di entrambe le istanze rimangono a carico di chi le ha anticipate mentre le ripetibili sono compensate.

  1. La procedura d'appello - inc. no- 12.2004.70 - promossa con appello 19 aprile 2004 da AP1, __________ contro il decreto 10 marzo 2004 del Pretore di Mendrisio-Nord è stralciata dai ruoli.

  2. La tassa di giudizio e le spese di complessivi Fr. 100.- sono a carico dell'appellante, compensate le ripetibili.

  3. Intimazione:
