per ottenere il pagamento dell’importo di Fr. 24’954.60 oltre interessi e spese e che il Pretore, con decreto 11 agosto 1998, ha stralciato dai ruoli per intervenuta perenzione.

Appellante la parte attrice la quale, con atto di appello 7 settembre 1998, chiede che il decreto di stralcio venga annullato mentre la controparte, con scritto 10 settembre 1998, aderisce alle conclusioni dell’appello.

Letti ed esaminati gli atti ed i documenti di causa.

Considerato

in fatto ed in diritto

che il Pretore ha stralciato la causa dai ruoli per la perenzione dell’art. 351 CPC poiché, a far tempo dal 24 agosto 1994 (data di un’istanza di completazione di perizia) e quindi per più di due anni consecutivi, nessuna delle parti ha compiuto un atto processuale;

che la parte attrice contesta il verificarsi della perenzione poiché la dichiarazione di fallimento a suo carico dell’11 luglio 1995 ha sospeso, per l’art. 207 LEF, la procedura e di conseguenza anche la decorrenza del termine di perenzione la quale non si sarebbe così compiuta;

che nella misura in cui una parte contesta dal profilo oggettivo il verificarsi della perenzione é ricevibile l'appello contro il decreto di stralcio (I CCA 6.12.1994 Di R. c. Di R.);

che, nel caso concreto, la causa di merito è sospesa ex lege (art. 207 LEF) a far tempo dall’11 luglio 1995;

che a quel momento la perenzione non era ancora intervenuta e che, nel seguito, la sospensione ha determinato l’interruzione della decorrenza del termine di perenzione (Cocchi/Trezzini, CPC, ad art. 351 n. 7);

che le condizioni per stralciare la causa dai ruoli così come evocate dal Pretore non si sono realizzate e la sua pronuncia (del resto anche almeno annullabile per essere stata emanata in un momento di sospensione obbligatoria del processo) deve essere annullata;

che l'accoglimento dell'appello è la conseguenza di un'iniziativa processualmente scorretta del primo giudice e di conseguenza non si prelevano tasse o spese di giudizio mentre le ripetibili sono a carico dello Stato (I CCA 27.9.1993 P. c. P. e II CCA 19.9.1994 F. SA c. I.);

Per i quali motivi

pronuncia

  1. L’appello è accolto e di conseguenza il decreto di stralcio 11 agosto 1998 della causa inc. no. OA.95.604 della Pretura di Lugano, sez. 2 in __________ (ora in fallimento) c. __________ è annullato.

  2. Non si prelevano tasse e spese mentre lo __________ verserà alla parte attrice Fr. 300.- per indennità ripetibile.
