preso atto che con sentenza del 9 maggio 2001 il Tribunale federale ha riformato il giudizio emesso il 6 novembre 2000 da questa Camera (inc. ..__________), rinviando gli atti per nuova decisione sulle spese e le ripetibili di primo e secondo grado;

accertato che la sentenza del Tribunale federale ripristina – in pratica – il sindacato del Pretore, ciò che giustifica di ripristinare anche il dispositivo sulle spese e le ripetibili emanato in quella sede (non impugnato dall'attore);

ritenuto che, seguendo il giudizio del Tribunale federale, in appello la convenuta sarebbe risultata del tutto soccombente e si sarebbe trovata quindi a sopportare gli oneri processuali del ricorso (art. 148 cpv. 1 CPC);

considerato che, nonostante la soccombenza, la convenuta può essere posta al beneficio dell'assistenza giudiziaria in appello (art. 155 CPC), date le gravi ristrettezze in cui versa e la circostanza che il suo gravame sembrava provvisto di buon diritto;

pronuncia: 1. Gli oneri processuali di appello, consistenti in:

a) tassa di giustizia fr. 1000.–

b) spese fr. 50.–

fr. 1050.–

sono posti a carico dell'appellante, che rifonderà alla controparte fr. 2000.– per ripetibili.
