Il giudizio sulle spese e le ripetibili.

Ritenuto

in fatto: che con sentenza del 20 maggio 1997 la I Camera civile di appello ha obbligato __________ -__________ __________, in parziale riforma della decisione emessa il 6 maggio 1996 dal Pretore della giurisdizione di Locarno-Campagna, a versare alla moglie __________ una pensione alimentare di fr. 705.– mensili sulla base dell’art. 152 CC;

che il 17 giugno 1997 __________ __________ __________ ha presentato alla Camera un’istanza di interpretazione in cui fa valere un errore di calcolo, essendo stato fissato il fabbisogno minimo della moglie in fr. 2’700.– dal 1° giugno 1997 (sentenza, pag. 10 consid. 8a in fondo), mentre tale fabbisogno ammonterebbe a fr. 2’530.–, di modo che la pensione alimentare sarebbe di fr. 535.– mensili;

che __________ __________ non ha formulato osservazioni;

considerando

in diritto: che a norma dell’art. 339 cpv. 1 CPC la correzione di una sentenza, se si tratta di errori materiali nella redazione o di semplice errori di calcolo, anche nei dispositivi, va richiesta in via di interpretazione;

che l’istanza di __________ -__________ __________ riguarda un asserito errore di calcolo relativo al fabbisogno minimo della moglie;

che tuttavia, contrariamente all’opinione dell’istante, la locazione di fr. 850.– mensili non deve essere aggiunta al fabbisogno della moglie fino al 31 maggio 1997, maggiorato del 20% (fr. 1’680.–);

che infatti il fabbisogno minimo calcolato dal Pretore, non contestato, aumentato della locazione di fr. 850.– e del supplemento del 20%, ammonta a fr. 2’700.– (fr. 1’400.– + fr. 850.– + fr. 450.–), onde l’inconsistenza del preteso errore;

che, invero, un errore di calcolo si ravvisa in merito alla possibilità per l’istante di far fronte al contributo (sentenza, consid. 9), poiché allo stesso rimane un’eccedenza di fr. 1’320.– (e non di fr. 1’490.–), ciò che tuttavia non ha alcuna incidenza sull’esito dell’appello;

che l’istanza di interpretazione presentata da __________ -__________ __________ risulta quindi infondata;

che per quanto concerne gli oneri dell’attuale giudizio appare equo – viste le circostanze del caso – esentare l’istante da tasse e spese, ancorché risulti soccombente, mentre non si giustifica di assegnare ripetibili alla controparte, che ha rinunciato a formulare osservazioni;

per questi motivi,

pronuncia: 1. L’istanza di interpretazione è respinta.

  1. Non si riscuotono tasse e spese né si assegnano ripetibili.
