contro

premesso che il 2 agosto 1993 __________ ha interposto appello contro un decreto cautelare emanato il 19 luglio 1993 dal Pretore del Distretto di Lugano, sezione 6;

constatato che il 26 agosto 1993 __________ __________ ha presentato a sua volta appello adesivo contro il medesimo decreto;

ricordato che il 23 novembre 1993 tale procedura è stata sospesa dal giudice delegato su richiesta delle parti, essendo in corso trattative;

preso atto che il 30 marzo 1998 l’attore ha comunicato al Pretore del Distretto di Lugano, sezione 6, di ritirare la petizione di separazione, ciò che equivale a desistenza (art. 77 cpv. 2 CPC);

rilevato che il 3 aprile 1998 l’appellante principale ha comunicato di acconsentire allo stralcio dell’appello, ciò che pone fine alla lite (art. 352 cpv. 1 CPC);

osservato che l’appello adesivo ha carattere accessorio e decade in caso di ritiro dell’appello principale (Anastasi, Il sistema dei mezzi di impugnazione del codice di procedura civile, Zurigo 1981, pag. 151; Poudret, Commentaire de l’OJF, Berna 1990, n. 2.7 ad art. 59 e 61), di modo che la parte che ritira l’appello principale deve, di principio, sopportare le conseguenze pecuniarie della caducità del ricorso adesivo (DTF 122 III 496 con riferimento);

accertato tuttavia che in concreto le parti hanno convenuto di lasciare le spese processuali a carico di chi le ha anticipate e di compensare le ripetibili;

considerato che la particolarità della fattispecie induce a non riscuotere spese né tassa di giustizia;

ritenuto che, per quanto attiene alle ripetibili, non vi è motivo per scostarsi dagli accordi presi dalle parti;

richiamato l’art. 352 cpv. 1 CPC,

decreta: 1. L’appello è stralciato dai ruoli per desistenza.

  1. L’appello adesivo è dichiarato caduco.

  2. Non si riscuotono spese né si assegnano ripetibili.
