ACCU 1 , difeso da: DI 1

prevenuto colpevole di circolazione in stato di ebrietà,

per aver condotto l’autovettura Renault targata __________ essendo in stato di ubriachezza (alcolemia: min. 0.81 – max. 1.51 grammi per mille);

fatti avvenuti a Porto Ronco il 14 febbraio 2004;

reato previsto dall’art. 91 cpv. 1 LCStr;

perseguito con decreto d’accusa n. DA 1862/2004 di data 24 maggio 2004 del AINQ 1 che propone la condanna dell'accusato:

Alla multa di fr. 1'000.-- (mille), con l’avvertenza che la stessa deve essere pagata entro 3 mesi ritenuto che in caso di mancato pagamento, sarà commutata in arresto (art. 49 cifra 3 CPS).

Al pagamento della tassa di giustizia di fr. 200.-- e delle spese giudiziarie di fr. 300.--.

La condanna verrà iscritta a casellario giudiziale e sarà cancellata entro un anno, se l’imputato avrà pagato la multa e tenuto buona condotta (art. 49 cifra 4, risp. art. 106 cpv. 3 CPS);

vista l'opposizione interposta tempestivamente in data 3 giugno 2004 dal difensore;

indetto il dibattimento 18 gennaio 2005, al quale hanno partecipato l’imputato ed il suo difensore, mentre il Procuratore pubblico ha rinunciato a presenziare, postulando la conferma del decreto d’accusa;

accertate le generalità dell'accusato, data lettura del decreto d'accusa, proceduto all'interrogatorio dell'accusato;

sentito il difensore, il quale dichiara innanzitutto che la fattispecie ed il reato imputati al suo cliente non sono contestati. Per contro, egli chiede, in considerazione delle lesioni subite dall’imputato, di applicare per analogia l’art. 66bis CPS e di mandarlo esente da pena. Egli si duole inoltre del fatto che il Procuratore pubblico non abbia nemmeno risposto ai suoi scritti, ciò che avrebbe permesso di evitare sicuramente l’odierno dibattimento. Egli postula inoltre che la tassa e le spese giudiziarie siano poste a carico dello Stato e che gli venga assegnato, a titolo di ripetibili, un importo di fr. 1'500.--. Egli chiede infine che la condanna non sia iscritta a casellario giudiziale;

  1. L'imputato è autore colpevole di circolazione in stato di ebrietà, per i fatti commessi nelle circostanze descritte nel decreto d'accusa n. DA 1862/2004 del 24 maggio 2004?

preso atto che nessuna parte ha chiesto nel termine di cui all'art. 276 cpv. 2 CPP la motivazione scritta della sentenza, né ha formulato dichiarazione di ricorso;

visti gli art. 91 cpv. 1 LCStr; 66bis CPS; 9 e segg., 273 e segg. CPP; 39 LTG;

rispondendo ai quesiti posti;

dichiara ACCU 1

autore colpevole di:

circolazione in stato di ebrietà, art. 91 cpv. 1 LCStr,

per i fatti compiuti a Porto Ronco il 14 febbraio 2004 nelle circostanze descritte nel decreto di accusa n. DA 1862/2004 del 24 maggio 2004;

manda ACCU 1 esente da pena;

carica allo Stato le tasse e le spese giudiziarie;

riconosce a ACCU 1 fr. 800.-- a titolo di ripetibili;

dispone che la condanna non venga iscritta a casellario giudiziale;

le parti sono state avvertite del diritto di presentare, per il suo tramite, dichiarazione di ricorso alla Corte di cassazione e revisione penale entro il termine di cinque giorni e del diritto di richiedere entro lo stesso termine la motivazione della sentenza (art. 276 cpv. 2 CPP).
