After an opposition to a criminal decree had been filed, the complainant withdrew the criminal complaint in writing. The Pretura penale therefore struck the proceedings from the docket and returned the file to the substitute public prosecutor for any further steps within his competence. The court ordered that no court fees or costs be levied.
Art. 31 cpv. 1 CPS; withdrawal of the criminal complaint renders the continuation of the proceedings unnecessary and justifies striking the case from the docket. Where the complaint is validly withdrawn, the court does not proceed to the merits but terminates the matter and, if appropriate, returns the file to the prosecuting authority. In such a situation, no procedural costs are charged absent a basis to the contrary.
