The President of the Criminal Court of Bellinzona recorded the accused’s withdrawal of his opposition to decree of accusation DAP 3005/2002. Applying Arts. 210 and 211 CPP, the court struck the proceedings from the roll, declared the decree of accusation enforceable, cancelled the already scheduled public hearing of 3 September 2004, and sent the file back to the prosecuting authority for further action within its competence. preso atto del ritiro della suddetta opposizione con lettera 1. settembre 2004,
visti gli art. 210 e 211 CPP,
decreta: 1. Il procedimento è stralciato dai ruoli e il decreto d'accusa diventa esecutivo.
Il pubblico dibattimento, già fissato per il 3 settembre 2004 alle ore 09:00 non avrà quindi luogo; l'incarto è ritornato al AINQ 1 per quanto di sua competenza.
Non si prelevano né tasse, né spese.
