Über die Entbindung eines Richters vom Amtsgeheimnis entscheidet das Obergericht


§ 12 Abs. 2 GerOG, Art. 320 Ziff. 2 StGB, § 18 Abs. 2 aStPO (TG)


Die Verletzung des Amtsgeheimnisses nach Art. 320 StGB ist nicht strafbar, wenn die vorgesetzte Behörde des Täters zur Offenbarung die schriftliche Einwilligung erteilt hat. Sowohl § 210 Abs. 1 Ziff. 3 ZPO wie auch § 91 Abs. 1 Ziff. 2 StPO sehen die Möglichkeit der Entbindung vom Amtsgeheimnis vor, wenn ein Geheimnisträger als Zeuge aussagen soll; gemäss § 91 Abs. 1 Ziff. 2 StPO muss die "vorgesetzte Behörde" der Einvernahme zustimmen.

Neben diesen Tatbeständen sind indessen auch andere Fälle denkbar, für die eine Geheimnisentbindung notwendig ist, wie etwa, wenn ein Richter zum eigenen Schutz gerichtlich vorgeht. Auch nach der materiell-rechtlichen Bestimmung des StGB wird verlangt, dass die Entbindung von der "vorgesetzten Behörde" auszugehen hat.

Ein Richter trifft seinen Entscheid in voller Unabhängigkeit und ist nur dem Gesetz verpflichtet; es fehlt bei ihm demgemäss ein "Vorgesetzter", wie er dem Beamtenrecht sonst eigen ist. Umgekehrt steht dem Obergericht gestützt auf § 55 Abs. 1 KV, § 12 Abs. 2 GerOG und § 18 Abs. 2 StPO die Aufsicht über die Zivilrechtspflege und die Strafgerichtsbarkeit zu. Gestützt auf dieses Aufsichtsrecht ist das Obergericht auch zuständig, einen Richter vom Amtsgeheimnis zu entbinden (vgl. ARGVP 1990 S. 93).
