Death of accused after appeal requires discontinuance

Omnilex-Zusammenfassung

The accused filed an appeal against a criminal judgment but died before the appeal was decided. The Rekurskommission held that death extinguishes the state's criminal claim and requires discontinuance of the proceedings. Because the appeal suspends finality of the first-instance judgment, the case remained pending before the appellate body, which had to issue the discontinuance order. The discontinuance covers the entire criminal case; the first-instance judgment does not become final as a whole once appealed.

Omnilex-Regeste

§§ 152 Abs. 2, 137 Abs. 2, 201 Abs. 1 StPO; death of the accused during pending appeal proceedings: the state's criminal claim lapses and the criminal proceedings must be discontinued by the appellate instance. An appealed first-instance criminal judgment does not attain finality or enforceability; the appeal suspends both effects. The discontinuance concerns the entire criminal case, not merely individual parts of the judgment, since partial finality exists only in the exceptional constellation of an appeal limited to the civil claim.

§ 151 Abs. 2 aStPO (TG) i.V.m. § 137 Abs. 2 aStPO (TG)

1. X erhob gegen ein Strafurteil Berufung. Er verstarb vor Erledigung des Rechtsmittels.

Dezember 1993).

Kernrechtsfrage

Whether the criminal proceedings had to be discontinued after the accused died during the appeal stage.

Extrahierter Entscheid

Yes. The state's criminal claim lapses on the defendant's death, so the appellate court must discontinue the entire criminal proceedings.

Extrahierte Begründung

A first-instance criminal judgment does not become final once an appeal is filed, because the appeal suspends finality and enforceability. Therefore the discontinuance must be ordered by the appellate instance while the case is still pending there; the entire criminal case is affected, not only parts of it.
