(Berufung gegen das Urteil des Bezirksgerichts March vom 10. November 2016, SGO 2015 17);-

hat die Kantonsgerichtsvizepräsidentin,

nachdem sich ergeben und in Erwägung:

  • dass die Privatkläger gegen das im Dispositiv eröffnete Urteil des Bezirksgerichts March vom 10. November 2016 fristgerecht Berufung anmeldeten (KG-act. 1);

  • dass das begründete Urteil am 11. April 2017 zum Versand kam und den Privatklägern bzw. deren Rechtsvertreter am 12. April 2017 zugestellt wurde;

  • dass innert der zwanzigtägigen Frist nach Art. 399 Abs. 3 StPO, welche am 2. Mai 2017 endete (Art. 90 StPO), keine Berufungserklärung beim Kantonsgericht einging;

  • dass die Befristungen für Berufungsanmeldung und -erklärung Gültigkeitsvorschriften sind, sodass zur gültigen Einlegung einer Berufung der diesbezügliche Wille zweimal zu erklären ist, abgesehen vom Fall, in welchem ein Urteil direkt begründet zugestellt wird (vgl. u.a. BGE 138 IV 157);

  • dass damit die Berufung zwar angemeldet, aber nicht erklärt wurde, was auf einen nachträglichen Verzicht hinausläuft, weshalb nicht nach Art. 403 Abs. 1 lit. a und Abs. 3 StPO zu verfahren, sondern die Berufung präsidial (§ 40 JG) abzuschreiben ist;

  • dass die Gerichtskosten der zweiten Instanz bei diesem Verfahrensausgang zu Lasten des Staates gehen und eine Entschädigung mangels Umtriebe nicht zu sprechen ist;-

verfügt:

1. Die Berufung wird als durch Verzicht auf Berufungserklärung erledigt abgeschrieben.

2. Die zweitinstanzlichen Gerichtskosten von Fr. 300.00 gehen zu Lasten des Staates.

3. Gegen diesen Entscheid kann innert 30 Tagen seit Zustellung nach Massgabe von Art. 78 ff. des Bundesgerichtsgesetzes *Beschwerde in Strafsachen * beim Bundesgericht in Lausanne eingereicht werden. Die Beschwerdeschrift muss den Anforderungen von Art. 42 BGG entsprechen.

4. Zufertigung an Rechtsanwalt C.________ (3/R), Rechtsanwalt E.________ (2/R), die Staatsanwaltschaft March (1/A), die Oberstaatsanwaltschaft (1/R) und an die Vorinstanz (1/A) sowie nach definitiver Erledigung an die Vorinstanz (1/R, unter Rückgabe der Akten) und an die Kantonsgerichtskasse (1/ü, im Dispositiv).
