Kernrechtsfrage
Whether bank-law auditors may refuse to produce files in criminal proceedings by invoking bank secrecy.
Extrahierter Entscheid
No. A bank-law auditor has no general right to refuse production in criminal proceedings on the basis of bank secrecy.
Extrahierte Begründung
The court followed the Federal Supreme Court’s interpretation that Art. 321 StGB covers only auditors bound by the Code of Obligations. Under Solothurn criminal procedure, the list of persons with absolute refusal rights is exhaustive and includes only auditors subject to the Code of Obligations. Bank-law auditors are subject to bank secrecy, but that secrecy does not create a general testimonial or production privilege; at most, an individual exemption may be possible under the code, and not where a felony is at issue.
