Kernrechtsfrage
Whether an investigating judge's opening order interrupted criminal limitation when the suspected offender was described only generally.
Extrahierter Entscheid
An opening order interrupts the limitation period only if the suspected offender is sufficiently individualized; a vague description of an indeterminate circle of persons is not enough.
Extrahierte Begründung
Art. 72 no. 2 StGB requires investigative acts against the offender. A measure directed merely against unknown or insufficiently identified persons does not serve as a limitation-interrupting act. The description of the suspected circle was too imprecise and left several possible persons open.
