When is non-payment of military substitute tax culpable under Art. 42 MPG?
Extrahierter Entscheid
Payment is not reasonably expected when the debtor needs other payments to cover indispensable living costs or to avoid immediate disproportionate hardship; as a rule, the relevant standard is the debtor's attachable income and the enforcement-law existence minimum.
Extrahierte Begründung
The court aligned culpability under Art. 42 MPG with the rules of debt enforcement. If income does not exceed the enforceable existence minimum, non-payment is not blameworthy. The public interest in equal treatment of conscripts is important, but it does not outweigh the debtor's claim to the absolute minimum needed for life. A debtor who withholds payment merely out of laziness or unwillingness remains punishable.
