Kernrechtsfrage
Whether the Code of Civil Procedure court-holiday rules apply to the challenge of a labor court judgment.
Extrahierter Entscheid
Yes. The exclusion of court holidays in the labor courts does not extend to the subsequent review procedure; the complaint period was therefore complied with.
Extrahierte Begründung
The labor-court exception is to be interpreted restrictively. Its purpose is the speed of first-instance labor proceedings, which does not govern the later review stage. Since the complaint does not suspend finality and provisional stay of enforcement remains possible, there is no reason to exclude court holidays. The milder interpretation should be preferred.
