How costs of interdiction proceedings should be allocated after withdrawal of the petition

The court treated interdiction as non-contentious jurisdiction and filled the gap in the cantonal rules by applying the former § 143 EGZGB/SO by analogy through Art. 1(3) ZGB. The authority had acted diligently and not frivolously, so no exception justified deviating from the general rule that the person to be interdicted bears the costs. However, the authority had itself requested only half the court costs, which the court accepted under the disposition principle; given the special nature of the case, set-off of party costs was justified.
