Omnilex-Zusammenfassung

The Obergericht, Criminal Chamber, held that under § 173(2) StPO the appellate court cannot expand criminal proceedings to new factual allegations at the appeal stage. The accused must already have been confronted with the accusation in full before the trial court, and appellate review is limited to the factual scope fixed by the lower court’s closing order and any related expansion or discontinuance orders. The court added that the prosecution remains free to file a new complaint regarding unadjudicated facts, but the appellate court may still reassess the legal characterization of a proven fact differently under § 116 StPO.

Omnilex-Regeste

§ 173 Abs. 2 StPO; the appellate criminal court may not extend the proceedings on appeal to new factual allegations or elements not submitted and adjudicated in first instance. The accused is entitled to certainty that appellate review is confined to the factual complex already covered below. The scope of adjudication is conclusively defined by the trial court’s closing order, as possibly supplemented by discontinuance or expansion orders. New allegations first raised in appeal are neither to be examined nor investigated. By contrast, the appellate court remains free to reassess the legal qualification of an established fact differently from the closing order and the first-instance judgment (consid. 1).

* Obergericht Strafkammer, Urteil vom 8. Januar 1975

Extrahierter Entscheid

No. In appellate proceedings, the Obergericht may not extend the case to new allegations or factual elements not already covered in first instance.

Extrahierte Begründung

The accused must be able to rely on the fact that only matters already adjudicated below will be examined on appeal.
