What remedy lies against execution decisions of the juvenile prosecutor?
Extrahierter Entscheid
A complaint may be brought before the Juvenile Chamber of the Obergericht.
Extrahierte Begründung
Under § 164 StPO the juvenile prosecutor is the executing authority in juvenile criminal law. § 54 EGStGB, in light of § 227(2)(d) StPO, remains applicable to execution decisions and designates the Juvenile Chamber of the Obergericht as the remedy instance. The broader appeal route is not excluded, but the court held the ordinary complaint under § 160(1) StPO to be the appropriate remedy.
