RZ.2007.61 ΓÇó Eviction action under Art. 197 lit. d ZPO need not meet clear-right test
RZ.2007.61Übriges Gericht14.09.2007Modified
Landlord A terminated a lease of two agricultural plots and sought a declaration of validity and an eviction order. The Kreisgerichtspräsident dismissed the claim without entering into the merits, holding that no clear right existed. On appeal, the Kantonsgericht held that eviction proceedings under Art. 197 lit. d ZPO are designed for swift protection and do not require clear law or liquid facts. The appeal was therefore upheld, the non-entry order annulled, and the case remitted for substantive determination.
Art. 197 lit. d ZPO; eviction proceedings against tenants or lessees; no requirement of clear law or liquid facts. Unlike the procedure under Art. 197 lit. a ZPO, the wording of Art. 197 lit. d ZPO does not make access to a merits decision contingent on a prima facie legal position or undisputed facts. The provision grants expedited judicial protection for eviction cases generally, so a court may not refuse to hear the action for lack of clear law alone (consid. III/1). If the first instance applies this stricter standard and declines jurisdiction on that basis, the decision must be set aside and the matter remitted for substantive adjudication (consid. III/2).
Erwägungen
I.
