The decision publication interprets Art. 23 of the ordinance implementing the Federal Act on National Roads. Expropriation may be initiated, at the owner's request or ex officio, only where land readjustment obviously cannot meet the owner's justified replacement claims for a specific parcel. The text gives as a classic example a manor estate within a consolidation perimeter that cannot in good faith be included in the land readjustment scheme; if such land is required for national road construction, expropriation, not land readjustment, must be used.

Gemäss Art. 23 der VV zum BG über die Nationalstrassen vom 10. September 1963 ist auf Antrag des Eigentümers oder von Amtes wegen das Enteignungsverfahren bloss dann einzuleiten, wenn das Landumlegungsverfahren berechtigten Ersatzansprüchen eines Grundeigentümers für ein bestimmtes Grundstück offensichtlich nicht zu genügen vermag. Als klassisches Beispiel für die Anwendung dieses Artikels stellt man sich nach Auskunft des Eidgenössischen Amtes für Strassen- und Flussbau einen herrschaftlichen Landsitz in einem Landumlegungsperimeter vor, der in guten Treuen nicht in die Güterzusammenlegung einbezogen werden kann. Muss ein solcher Landsitz für den Nationalstrassenbau beansprucht werden, kann hiefür nicht das Landumlegungsverfahren zur Anwendung kommen, sondern offensichtlich nur das Enteignungsverfahren.
