A neighboring owner appealed against a building permit after his objection had been filed too late. The municipal council had issued the permit and refused to enter on the objection. The administrative court dismissed the appeal because the appellant did not contest the non-entry ruling and argued only the merits of the permit. The court added that no grace period could be granted under § 135 Abs. 2 VRG, since such a period may only cure or supplement an already minimally reasoned appeal, not replace a missing substantive reasoning altogether.
§ 107 Abs. 2 lit. e, § 107 Abs. 3 VRG; § 135 Abs. 2 VRG: Non-entry on a late objection is unobjectionable if the objection period has expired and the party does not challenge the timeliness issue in the appeal. A curing period for defects in pleadings presupposes at least an incipient case-related reasoning; it serves to improve or supplement a deficient submission, but not to supply a wholly missing substantive justification ex post. Where the appeal contains no material engagement with the contested non-entry decision, there is nothing that can be remedied.
Im Rahmen eines Baubewilligungsverfahrens zeigte der Gemeinderat das Baugesuch u.a. dem Anstösser A an. Im übrigen lag das Baugesuch auf der Gemeindekanzlei öffentlich auf. Nach Ablauf der Auflagefrist reichte A dagegen eine Einsprache ein. Der Gemeinderat erteilte die Baubewilligung und trat auf die Einsprache von A zufolge Verspätung nicht ein. A zog diesen Entscheid ans Verwaltungsgericht weiter und machte geltend, das Bauvorhaben verletze materielle Bauvorschriften.
Das Verwaltungsgericht wies die Beschwerde mit folgender Begründung ab:
