The appellant argued that under § 52 StrG the road association could become owner of the main access road and bear the road burden only if the road land was parcelled. The court rejected this view, holding that § 52 StrG establishes ownership of the road as a rule but expressly reserves special legal relationships. A waiver of parcelation is therefore permissible without any special preconditions. The challenged decision was accordingly not contrary to § 52 StrG.
§ 52 StrG; ownership of road land and waiver of parcelation: the rule that the road association becomes owner of the road and that demarcation of the road terrain is generally required is not absolute. The second sentence of § 52 StrG expressly preserves special legal relationships. A waiver of parcelation is therefore permissible; no special prerequisites are required for such waiver (consid. 2).
Aus den Erwägungen:
Die zitierte Bestimmung von § 52 StrG hält zwar als Regel fest, dass die Strassengenossenschaft Eigentümerin der Strasse wird, was eine Ausmarchung des Strassenterrains bedingt. In Satz zwei behält diese Bestimmung aber ausdrücklich besondere Rechtsverhältnisse vor. Auf die Ausmarchung kann daher ohne weiteres verzichtet werden (Urteil R. vom 22.9.1977; LGVE 1982 II Nr. 6). Entgegen der Auffassung des Beschwerdeführers sind für den Verzicht auf die Ausmarchung keine speziellen Voraussetzungen vorgeschrieben. Der angefochtene Entscheid verstösst somit nicht gegen § 52 StrG.
