Grundsätzlich stellt die Verpachtung von Grundstücken ein privatrechtliches Rechtsgeschäft dar. Der Eigentümerschaft von landwirtschaftlichen Grundstücken ist es jedoch nicht freigestellt, ob und an wen sie die Grundstücke verpachtet. Bei der Verpachtung von landwirtschaftlichen Grundstücken sind die Bestimmungen des Bundesgesetzes über die landwirtschaftliche Pacht (LPG; SR 221.213.2) zu beachten. Danach bedarf die parzellenweise Verpachtung einer Bewilligung (Art. 30 Abs. 1 LPG). Die Bewilligung darf nur erteilt werden, wenn eine der in Artikel 31 LPG genannten Voraussetzungen erfüllt ist.

Korporationsgemeinden haben neben diesen Bestimmungen noch § 41 des Gemeindegesetzes (SRL Nr. 150) zu beachten. Gemäss § 41 des Gemeindegesetzes sind Korporationsgemeinden zwar befugt, innerhalb des gesetzlichen Rahmens die Verwaltung und die Nutzung ihres Vermögens frei zu regeln, allerdings mit dem Vorbehalt, dass die Regelung der Nutzungsberechtigung nicht zu Unbilligkeiten führen darf. Im Korporationsreglement und im Landpachtreglement hat die Personalkorporation A diese Vorschrift konkretisiert. § 2 Absatz 1 des Verwaltungsrechtspflegegesetzes (VRG; SRL Nr. 40) bezeichnet als Behörde oder Instanzen alle mit hoheitlicher Wirkung handelnden Organe des Gemeinwesens. Dem Verwaltungsrechtspflegegesetz ausdrücklich unterstellt sind die Gemeindebehörden und somit auch die Korporationsräte (§ 6 Abs. 1b VRG). Der Korporationsrat der Personalkorporation A hat mit seinem angefochtenen Entscheid im Einzelfall über Rechte und Pflichten des Beschwerdeführers entschieden. Dieser Entscheid ist als Entscheid im Sinne von § 4 Absatz 1 VRG zu qualifizieren.
