Gemäss § 3 Absatz 2 des Gesetzes betreffend das Berg-Regal vom 6. März 1918 (Bergregalgesetz; SRL Nr. 670) haben die Gemeinden, auf deren Gebiet sich die regalpflichtigen Rohstoffe befinden, unter mehreren Bewerbern das Vorrecht auf die Verleihung (Konzession). Die Gemeinde, die das Vorrecht geltend macht, hat die Schürfung und Ausbeutung auf ihrem Gebiet selber, auf eigene Rechnung und Gefahr, zu betreiben. Zu diesem Zweck hat sie einen entsprechenden Finanzierungsausweis zu erbringen.

In diesem Sinn hat, mit Ausnahme der Gemeinde X, keine Gemeinde vom Vorrecht Gebrauch gemacht. Der Gemeinderat von X hat mit Schreiben vom 11. Nicht unter das Regal fallen hingegen Steinbrüche, Erden, Salpeter, Heilquellen, Torf, Lehm, Sand und Baumaterialien (Abs. 2). § 2 des Bergregalgesetzes bestimmt zudem klar, dass der Staat das Recht hat, nach den dem Bergregal unterstellten nutzbaren Stoffen zu suchen oder suchen zu lassen (Schürfen) und diese auf eigene Rechnung auszubeuten oder die Ausbeutung derselben zu verleihen. Den Gemeinden steht unter mehreren Bewerbern nur das Vorrecht auf Verleihung zu (§ 3 Abs. 2).
