Corporate council lease allocation is an administrative decision

RRE Nr. 437Übriges Gericht20.03.1998

Omnilex-Zusammenfassung

The excerpt explains that the allocation of agricultural corporate land by a corporate council is not merely a private lease but a public-law task governed by the Agricultural Tenancy Act, the Municipal Act, and the corporation's regulations. As a result, the council acts with sovereign effect, and its individual ruling on the complainant's rights and duties constitutes a decision under the Administrative Procedure Act. Such a decision was, under the former law, challengeable by administrative complaint to the Regierungsrat.

Omnilex-Regeste

Art. 30 and 31 LPG; § 41 Gemeindegesetz; § 2 Abs. 1, § 4 Abs. 1, § 6 Abs. 1b and § 142 Abs. 1b VRG; qualification of the corporate council's allocation of agricultural corporate land as an administrative decision. The leasing of agricultural land is generally private law, but where statutory tenancy control applies and corporate municipalities regulate land use under public-law norms, the allocation of tenancy rights is a sovereign act. The deciding organ determines rights and duties in an individual case and therefore issues a decision within the meaning of the VRG; such decisions are subject to administrative complaint to the competent supervisory authority.

Gesamter Gesetzestext

Januar 1997).

Kernrechtsfrage

Whether the lease allocation of agricultural corporate land by the corporate council is a public-law decision under the Administrative Procedure Act.

Extrahierter Entscheid

Yes. Because the corporate authorities act with sovereign effect when allocating corporate land under the governing public-law rules.

Extrahierte Begründung

Although leasing land is generally a private-law transaction, the leasing of agricultural land is subject to the Agricultural Tenancy Act and, for corporate municipalities, to § 41 of the Municipal Act and the corporation's own regulations. The allocation of use rights is therefore a public-law task, and the corporate council decides on rights and duties in an individual case.

Kernrechtsfrage

Whether the corporate council's decision can be challenged by administrative complaint to the Regierungsrat.

Extrahierter Entscheid

Yes. The decision qualifies as an 'Entscheid' within the meaning of the Administrative Procedure Act and is therefore subject to administrative complaint.

Extrahierte Begründung

Bodies of municipalities, including corporate councils, are expressly subject to the Administrative Procedure Act. An individual ruling determining rights and obligations is a decision under § 4(1) VRG, and such decisions were appealable to the Regierungsrat under the then-applicable § 142(1b) VRG.
