Omnilex-Zusammenfassung

The court held that the revised § 155 ZPO governs requests for production from administrative authorities only when they are not parties to the civil case. If the authority is itself a party, the civil judge determines which documents must be produced, with the evidentiary rules of §§ 152, 160, and 164 ZPO applying and any refusal to produce to be weighed under § 143 ZPO. The decision stresses separation of powers and the role of official secrecy in administrative disclosure decisions.

Omnilex-Regeste

§ 155 ZPO; document production by administrative authorities in civil proceedings; the special rule applies only where the authority is not itself a party. If the administrative authority is a litigant, the court — not the authority — decides the scope of document production under the evidentiary regime of §§ 152, 160 and 164 ZPO; a refusal to produce is to be taken into account in the appraisal of evidence under § 143 ZPO. The revised provision establishes a specific interface between civil procedure and administration, but does not displace the judge’s evidentiary authority in cases of party status. Consideration must be given to separation of powers and official secrecy (consid. not specified).

Gesamter Gesetzestext

LGVE 1991 I Nr. 20).
