The defendant filed an appeal brief by fax on the last day of the deadline and said the signed original would follow. The court held that fax submissions are not valid pleadings because they lack an original handwritten signature, and a later original would be out of time. The defective fax filing could not be cured. The court therefore refused to enter into the appeal.
§§ 69 Abs. 1, 71, 88 Abs. 1, 249 Abs. 2 ZPO; faxed appeal brief without handwritten signature and later original after expiry of the appeal period. A fax transmission does not constitute a valid pleading or remedy filing, because the requirement of an original handwritten signature is mandatory; the same applies to photocopied signatures. An untimely later submission of the original cannot remedy the defect. An ineffective fax filing is not capable of rectification and leads to non-entry on the appeal.
Am letzten Tag der Notfrist übermittelte der Beklagte dem Obergericht um 23.55 Uhr per Telefax eine Kurzbegründung für seine Appellation und stellte die Nachsendung des Originals in Aussicht. Das handschriftlich unterzeichnete Exemplar der Appellationsbegründung ging jedoch beim Obergericht bislang nicht ein.
Aufgrund dessen ist die vom Beklagten per Telefax eingereichte Appellationsbegründung rechtlich unbeachtlich. Ein nachträglich per Post zugestelltes Original müsste als verspätet eingereicht betrachtet werden (§ 88 Abs. 1 ZPO). Die fristgerecht übermittelte, aber unbeachtliche Telefax Sendung ist - ebenso wie eine nicht innert Frist eingereichte Rechtsschrift - nicht verbesserungsfähig im Sinne von § 71 ZPO. Auf die Appellation ist androhungsgemäss nicht einzutreten (§ 249 Abs. 2 ZPO).
