Hinsichtlich der erstinstanzlichen Kostenverlegung machte die Klägerin geltend, die vom Amtsgericht vorgenommene Auslegung von § 154 lit. a ZPO sei unkorrekt; es handle sich dabei um überspitzten Formalismus. Editionsanträge seien gestellt worden, und der Beklagte sei diesen nicht nachgekommen. Folglich hätte die Klage in Anwendung der prozessualen Bestimmung von § 154 ZPO im eingeklagten Umfang gutgeheissen werden müssen. Dies bewirke, dass der Beklagte sämtliche erstinstanzlichen Kosten zu tragen habe. Dieser Antrag könne entsprechend der geltenden Rechtsprechung auch ohne Appellation bzw. Anschlussappellation gestellt werden.

Es trifft zu, dass das Obergericht auf Antrag des Appellaten den vorinstanzlichen Kostenspruch - auch ohne Einreichung einer Anschlussappellation - abändern kann (§ 247 Abs. 3 ZPO; LGVE 1984 I Nr. 15). Eine Abänderung ist indes nur dann möglich, wenn die vorinstanzliche Kostenverlegung nicht vorwiegend auf dem materiellen Ergebnis des erstinstanzlichen Urteils beruht. Folglich hätte die Klägerin, um eine Änderung des erstinstanzlichen Kostenspruches zu erwirken, ihrerseits (erfolgreich) appellieren bzw. sich der Appellation anschliessen müssen, was sie nicht getan hat. Auf den Antrag der Klägerin im Kostenpunkt ist demzufolge nicht einzutreten. Selbst wenn darauf einzutreten wäre, ist hinsichtlich der von der Klägerin geltend gemachten Editionsverweigerung im übrigen festzuhalten, dass eine ausdrückliche Verweigerung seitens des Beklagten (vgl. Max. VIII Nr. 207) nicht vorliegt; auch wurde der Editionseid nicht verlangt. Unter diesen Umständen aber konnte vom Amtsgericht nicht im Sinne von § 154 lit. a ZPO der von der Gegenpartei behauptete Inhalt der Urkunde als erwiesen angenommen werden.
