Der Beklagte macht in seinem Rekurs geltend, für grundpfandversicherte Forderungen müsse die Betreibung auf Grundpfandverwertung gegen die Liquidationsmasse geführt werden. Eine Betreibung gegen den Schuldner persönlich sei nicht möglich. Aus diesem Grund sei die gegen ihn eingeleitete Betreibung unrechtmässig, und er sei auch in diesem Rechtsöffnungsverfahren nicht passivlegitimiert.

Dieser Einwand des Beklagten geht fehl. Zwar ist dem von ihm zitierten BGE 84 III 105 ff. tatsächlich zu entnehmen, dass die Gläubiger grundpfandgesicherter Forderungen trotz Abschlusses eines Liquidationsvergleichs ihre Forderungen ausserhalb des Liquidationsverfahrens durch Grundpfandbetreibung gegen die Liquidationsmasse geltend machen können. Der diesem Bundesgerichtsentscheid zugrunde liegende Fall unterscheidet sich jedoch vom vorliegenden insofern, als dort das Grundpfand Eigentum des Schuldners war (BGE 84 III 105), während es hier im Eigentum der Ehefrau des Beklagten, d. h. in Dritteigentum steht. Pfandgegenstände aber, die im Eigentum Dritter stehen, gehören nicht zur Liquidationsmasse (Ludwig Peter, Der Nachlassvertrag mit Vermögensabtretung [Liquidationsvergleich], Abhandlungen zum schweizerischen Recht, Heft 403, Bern 1970, S. 69). Folglich hat die Klägerin zu Recht den Beklagten, den sie in Anwendung von Art. 832 Abs. 2 ZGB trotz Übergangs des Pfandeigentums auf dessen Ehefrau ausdrücklich als Schuldner beibehalten hat und der mit der richterlichen Bestätigung des Nachlassvertrages für alle nicht dem Nachlassvertrag unterworfenen Verbindlichkeiten wieder voll betreibungsfähig geworden war (BGE 84 III 110f.; Amonn Kurt, Grundriss des Schuldbetreibungs- und Konkursrechts, 4. Aufl., Bern 1988, S. 450 Rz 73), auf Verwertung des Grundpfandes betrieben. Die Passivlegitimation des Beklagten ist somit auch im vorliegenden Rechtsöffnungsverfahren gegeben, weshalb sein Rekurs in diesem Punkt abzuweisen ist.
