The plaintiff in summary proceedings asked, as a precaution, for production of a report concerning delivery of a registered letter. The court held the request to be irrelevant because the plaintiff had said she would obtain the postal confirmation herself. It further noted that in summary proceedings evidence is generally limited to documentary evidence and party examination, and that a document production procedure is excluded where the burdened party can readily obtain the document independently. If such a document is not produced, the burdened party bears the consequences of failing to prove the fact.
Art. 8 ZGB; document production in summary proceedings: where the evidentiary document can readily be obtained by the burdened party itself, an edition procedure is not admissible. In summary proceedings, proof is in principle confined to documents and party examination; a party that omits to file a self-obtainable document bears the consequences of non-proof (consid. implied).
In einem Befehlsverfahren wurde u. a. die Edition eines Berichtes über die erfolgte Zustellung einer Einschreibesendung beantragt. Dazu wurde ausgeführt:
"Vorsorglich" hat die Klägerin noch die Edition "eines Berichtes über die Zustellung . . ." beantragt. Unter Hinweis auf die klägerische Angabe, sie werde sich um eine Postbestätigung selber bemühen, ist dieser Antrag zum vornherein unbeachtlich. Es kommt hinzu, dass im (summarischen) Befehlsverfahren in der Regel nur der Beweis durch Urkunden und Parteibefragung zugelassen ist. Ein Editionsverfahren nach §§ 148 ff. ZPO für eine Urkunde, die sich der Beweisbelastete problemlos selber beschaffen kann, ist jedenfalls ausgeschlossen. Wer somit im Summarverfahren als Beweisbelasteter eine von ihm selber beschaffbare Urkunde nicht auflegt, hat die Folgen der Beweislosigkeit zu tragen (Kummer, Berner Kommentar, N 36 zu Art. 8 ZGB).
