Mit Entscheid vom 10. Dezember 1996 wies das Obergericht den gegen die Haftverfügung des Amtsstatthalters von Luzern-Land vom 25. November 1996 eingelegten Rekurs ab. Die dagegen eingereichte staatsrechtliche Beschwerde hiess das Bundesgericht gut, weil es den Weiterbestand des Haftgrundes Fluchtgefahr verneinte; es ordnete an, den Beschwerdeführer - allenfalls mit gewissen Auflagen im Sinne von § 83ter Abs. 2 StPO - aus der Haft zu entlassen. Zur Vollzugsfrage äusserte sich die II. Kammer des Obergerichts wie folgt:

Die staatsrechtliche Beschwerde ist grundsätzlich kassatorischer Natur, d.h. es kann mit ihr nur die Aufhebung des angefochtenen Entscheides durch das Bundesgericht verlangt werden. Eine Ausnahme gilt nach bundesgerichtlicher Rechtsprechung allerdings dann, wenn die von der Verfassung geforderte Rechtslage nicht schon mit der Aufhebung des kantonalen Entscheides hergestellt wird, sondern dafür eine positive Anordnung nötig ist. Das trifft hinsichtlich einer nicht oder nicht mehr gerechtfertigten Untersuchungshaft zu (BGE 105 Ia 29, zit. in BGE 115 Ia 297 E. 1 mit Verweisen; vgl. ZR 87 [1988] Nr. 124 S. 293).

Entsprechend dieser Praxis hat das Bundesgericht vorliegend entschieden, dass der Angeschuldigte aus der Haft zu entlassen sei. Dieser Entscheid hat aber keine unmittelbare Wirkung. Es bedarf zur Haftentlassung eines neuen Entscheides des Obergerichts, der den vom Bundesgericht hier aufgehobenen Rekursentscheid ersetzt und die Voraussetzungen für den Vollzug des bundesgerichtlichen Entscheides schafft (Marti Hans, Die staatsrechtliche Beschwerde, Basel 1979, 4. Aufl., Ziff. 313). So hat es das Bundesgericht in seinem staatsrechtlichen Beschwerdeentscheid vom 23. Januar 1997 denn auch dem Obergericht überlassen, die Haftentlassung mit Auflagen im Sinne von § 83ter Abs. 2 StPO zu verknüpfen. Im übrigen bedingt der Erfolg der staatsrechtlichen Beschwerde auch, dass das Obergericht über die Kosten des ersten Rekursverfahrens neu entscheidet.
