The case concerns definitively seized dogs whose owner could no longer care for them. The owner proposed placing the animals in Italy, but the court held that this was incompatible with the cantonal veterinary office’s need to supervise detention conditions at all times. The request was therefore rejected and the protective measure maintained.
OPA. 1; definitively seized animals may only be placed where the competent authority can ensure continuous control of their detention conditions. A foreign placement is inadmissible if it prevents effective supervision by the veterinary authority and thereby undermines the purpose of the protective measure.
