Zusammenfassung

A professional taxi driver with three prior warnings and two earlier licence withdrawals committed a further speeding offence by 29 km/h. In view of this record, the court held that a warning would not be sufficient and that a driver’s licence withdrawal was required. The challenge to the sanction was therefore rejected.

LCR art. 16 al. 3; repeated traffic offences and antecedents justify withdrawal of the driving licence rather than a mere warning. Where the offender has already been sanctioned several times and again exceeds the speed limit significantly, the authority may impose the more severe measure if a warning would not adequately meet the preventive and disciplinary purpose of the law.

Un nouveau dépassement de 29 km/h de la vitesse maximale autorisée, doit être par conséquent sanctionné par un retrait de permis. Un simple avertissement ne serait vraisemblablement pas suffisant, vu les antécédents de l'intéressé.
