The Tribunal administratif dismissed the appeal against an administrative fine imposed after the unauthorized felling of an oak tree with a circumference of about 3 meters. It held that the competent authority had not abused its discretion in imposing the sanction, and the fine of CHF 3,000 was maintained.

The reviewing court will not interfere with the sanction where the competent authority has remained within its margin of appreciation and the seriousness of the unlawful act justifies the penalty. Confirmation d'une amende administrative de CHF 3'000.- infligée par la commission LCI suite à l'abattage non autorisé d'un chêne de 3 mètres de circonférence. Selon le TA, le DIEAR n'avait pas abusé de son pouvoir d'appréciation en condamnant à la taxe le recourant à une amende de CHF 5'000.-.
